After careful consideration of the Subdivision and Development Appeal Board (SDAB) decision and advice from legal counsel the Rossdale Community League executive voted to file an appeal to the SDAB decision regarding the location of a fire station in Rossdale. This is not a decision we have taken lightly and we have taken into account the many opinions we have heard in the last months. We are concerned that the SDAB decision provides a permit that goes beyond the extent of fire services that City Council determined could be located in Rossdale. In addition we are concerned that the SDAB decision states that the linear park outside of the site will mitigate the nuisance effects of the fire station and yet there is no assurance that the linear park will be developed.
The process for an appeal is that an application is first made for permission to appeal. If the court finds that there are grounds for the appeal to proceed a date is set for full hearing of the appeal.
At this point we feel that it is in the best interest of the community to pursue this matter further. However we are very mindful of the risks of litigation and we will be monitoring the situation carefully. We will provide updates on the progress of the appeal and share as much information as we are able to, given that we will be engaged in a legal process.
